The need for preliminary examination is set out in the No. 314/2005. (XII.25.) regulation. If the planned activity (or expansion of activity) is listed in Annex 3 of the above regulation, a preliminary examination documentation must be compiled and submitted to the environmental authority, which conducts the preliminary inspection procedure itself.
As its name indicates, the procedure is a preliminary authorization, which precedes but does not replace the licensing of the activity (for example, in the case of waste management activities). After the preliminary inspection procedure has taken place, further licencing procedure may be required.
Licensing - license application
On the basis of Annex 4 to the above mentioned Regulation the license application for a preliminary examination should include the description of the location (site), the technology of the planned activity as well as its effects on various environmental elements, such as water, soil, air, wildlife, noise and waste.
Deadline
Authority has 45 days for making decision in a preliminary examination. The environmental authority issues a pending decision after the application is submitted, which almost excludes the possibility of extending the 45 days (60 days).
Administrative fee
The official administrative fee is 250.000 HUF, which is strongly recommended to pay in advance and attach the proof of payment to the submitted documentation.
Examples of preliminary examination
- waste recycle above 10 tonnes/day (for e.g. construction / demolition waste)
- waste collection and / or pre-treatment / recycling site
- residential parks, industrial parks
- activities on more than 3 ha area
- activities on Natura2000 area (protected natural areas)
Additional permissions / licensing
After the preliminary inspection procedure is closed some further environmental license is usually required for the company to start working. These permits are not included in the preliminary examination. These can be for e.g. waste management license, air protection permit, water rights permit, noice limit application, etc.
Expert License
A valid expert license for different environmental elements such as water, soil, air, wildlife, noise and waste is required for a preliminary inspection documentation preparation. I have not only big experience, but expert licences for complining such kind of documentation as well.
